General Terms and Conditions
These conditions apply to all Spanish courses for foreigners offered by Guay Spanish School and are regulated by the General Law for the Protection of Consumers and Users and other applicable regulations in Spain and the European Union.

DEFINITION OF THE SERVICE COVERED BY THE CONTRACT
The contracting of our Spanish courses is subject to completing the registration form or accepting the budget, together with accepting the general conditions and privacy written. It will be formalised once the reservation payment has been made.

PAYMENT METHODS (€)
Always in euros and by the following ways:
- Bank transfer: the payment must include the name of the student or group. Any bank charges will be borne by the student.
- Credit card: in person at the school.
- Cash: also in person, and 500€ bills are not accepted.
DISCOUNTS AND OFFERS
Discounts, offers and their publications are not cumulative and have a limited duration. They may only be used by students who effectively formalise their registration at its time. All offers are subject to the viability of the courses offered. No changes will be accepted to bookings received prior to the offer or promotion.
REGISTRATION CANCELLATION POLICY
Our students may cancel the course for any reason and at any time, but depending on the circumstances of the contract and cancellation, they will be entitled to a percentage refund or other.
Cancellation of the registration
- Students may cancel their registration up to 14 calendar days before the start of the course with no additional cost.
- If cancellation is made between 13 and 7 days before the start of the course, a penalty of 30% of the total amount will be applied.
- Cancellations made less than 7 days before the start date will not be eligible for a refund. Except in cases of force majeure, which must be supported by documentary evidence.
RIGHT OF WITHDRAWAL
- In accordance with the General Law 3/2014 for the Defence of Consumers and Users, belonging to the European Union, students have 14 calendar days from the confirmation of the registration to withdraw, as long as the course has not yet begun.
RETURNS AND REFUNDS
- If the cancellation meets the above conditions, the refund will be made within a maximum period of 14 calendar days from the acceptance of the request.
- The refund will be made using the same payment method used for registration.
- Bank charges will be borne by the student except in the case of cancellation by Guay Spanish School.
Courses already started
Once the course has started, no returns or refunds will be accepted, except in justified cases of force majeure, which must be proved with documentary evidence.
PROCEDURE FOR REQUESTING CANCELLATION
Send an email to hola@guayspanishschool.com indicating “CANCELLATION” or “WITHDRAWAL” in the subject line and include:

Guay Spanish School will confirm receipt and resolution within a maximum of 3 working days.
If you made the payment by bank transfer, please attach proof of ownership of the bank account.
EXCEPTIONS
- No refunds will be given for:
– Personalised courses or private lessons that have already been given.
– Downloadable or digital materials.
- A refund will be given in the case of a study visa being denied, minus 150€ of administrative fees. It is essential to present the official letter of visa denial for study purposes.
- The amount paid for the academic programme with a student visa will not be refunded if:
- The reason for the visa refusal was due to the provision of false documentation.
- Falsification of the refusal letter.
MODIFICATION OF PRIVATE CLASSES
Date changes for individual Spanish lessons are permitted within a period of 5 working days. Only one change per 8 hour bonus is permitted.
CANCELLATION/MODIFICATION BY THE SCHOOL
Guay Spanish School reserves the right to cancel the course in the following cases:
- If the student does not make the corresponding payments on the dates indicated.
- If one week before the course there is not a minimum of 5 students. In this case, other options will be proposed (reduction of the contracted hours by a percentage) or a refund. We will always clearly inform the student and they will be notified if this situation occurs. In any case, this is not a common occurrence.
- Due to force majeure: Pandemic, floods, power cuts… or any other event that prevents the course or lesson from being taught, the student will be offered the option of changing the date or cancelling for a refund.
CALENDAR
The school is closed on regional and national public holidays, as well as during four holiday periods. However, students only pay for school days, never for public holidays or vacations.
Public holidays: 19 March, Saint Joseph’s Day; 1 May, Labour Day; 9 June, Region of Murcia Day; 12 September, Romería Day; 12 October, Hispanic Heritage Day; 1 November, All Saints’ Day; 6 December; 8 December, Spanish Constitution Day.
Holiday periods:
Christmas: from the date schools close until the date schools reopen in Murcia.
Easter: from Holy Monday to Easter Sunday.
Spring holidays: from the Monday after Easter Sunday to the following Sunday.
Summer: from 1 to 31 August.
ACCOMMODATION INFORMATION SERVICE
Guay Spanish School will provide students with information about accommodation if they enrol in an intensive course of 20 hours per week for a minimum duration of 4 weeks. Students will make their own reservations directly with the company or individual they are interested in, without intermediaries or commissions.
We recommend requesting this service at least 4 weeks before the start of the course.
INSURANCE
Non-European students must have insurance that covers any possible incidents that may occur during the course.
The school will not be liable in any way for accidents, loss or damage to students or their belongings during classes, accommodation or any school-related activities. If you wish, we can help you arrange insurance.
Any booking will confirm acceptance of all these terms and conditions, without the need for the student to sign them.
PROCESSING OF YOUR PERSONAL DATA
In compliance with current legislation, CERVANTES COLLEGE ARVEMAR S.L. and its brand GUAY SPANISH SCHOOL undertake to adopt the necessary technical and organisational measures, according to the level of security appropriate to the risk of the data collected.
This privacy policy complies with current Spanish and European regulations on the protection of personal data on the internet. Specifically, it complies with the following regulations:
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).
Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD).
Royal Decree 1720/2007 of 21 December, approving the Regulations implementing Organic Law 15/1999 of 13 December on the Protection of Personal Data (RDLOPD).
Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).
CERVANTES COLLEGE ARVEMAR S.L., with Tax Identification Number B73814345, will be responsible for the personal data you provide us with by filling in any of our paper or electronic forms, as well as for the data obtained as a result of the formalisation or information about a course, where the student or their legal representative will give their express consent and sign to authorise the centre to use their personal data in accordance with the law.
Your personal data will not be used for commercial, marketing or promotional purposes for third parties.
Furthermore, unless expressly stated otherwise, students enrolled in a face-to-face course agree that their photos may be used for advertising purposes when they appear in photos or videos taken within the school or during extracurricular activities.

LEGAL SYSTEM
Any disputes that may arise as a result of the application, interpretation, and fulfilment of contracts shall be resolved in the Courts and Tribunals of Murcia.
